Terms and Conditions
Welcome to FAKRO America online store (the „Store”). Below listed terms and conditions, you agree to accept and follow while using the Store. Please make sure you read the terms and conditions carefully. At any time, Fakro has the right to change, modify and update the terms and conditions without prior notice.
These terms and conditions together with your Order Confirmation constitute the Contract between FAKRO America and you for the supply of Products. No other terms and conditions shall apply.

Placing your oder
To place an Order you must be 18 years of age or over. If you are under 18, you can use the Store only with involvement of a parent or guardian. By placing an Order, you make an offer to purchase the Products you have selected on these terms and conditions.

When you place your Order, we will issue you with a Web Order Number.
If we accept your Order, we will notify you of our acceptance by issuing an Order Confirmation. We will send your Order Confirmation to you by e-mail to provided by you e-mail address. If we can not accept your Order, we will attempt to contact you by email or telephone.

Whilst we will make every effort to supply you with the Products listed on the Order Confirmation as quickly as possible, but there may be occasions where we are unable to supply these Products because, for example, (i) purchased product is not available at the moment of placing the order, (ii) such products are no longer being manufactured or available, (iii) if there was a pricing error on the website. In such circumstances we will contact you to inform you and may suggest alternative Products that you might wish to purchase. If you do not accept our suggestions then we will cancel your Order in relation to those Products we cannot supply and repay you any money that you may have paid to us in respect of those Products.

Product Pricing; Shipping Charges; Taxes.
The purchase price for the Product is the price listed in the FAKRO online store at the time you place your order. Delivery cost for shipping and handling are payable by you, and will be added to your order. Sales and all other taxes associated with the order are charged to your credit card account.
The Product price, shipping costs and taxes will be also indicated on your invoice.

You may pay for your products with MASTERCARD, VISA, AMERICAN EXPRESS credit cards. You will be asked to provide your name (as shown on your credit card), Card number and expiration date. Your credit card will be charged when we issue your invoice or on shipment of your Products. We will not commence the preparation of your Products neither will we supply the Products to you until credit card issuing company has authorized the use of your card for payment of the ordered Products. If we do not receive such authorisation we shall let you know.

FAKRO America L.L.C. has the right, without prior notification, to reduce the order quantity on any ordered item and/or refuse service to any customer.

Title and Risk of Loss
Title to and risk of loss in your Products will pass to you on the shipment of the Products from FAKRO America. The means of transport of the goods shall be at the discretion of FAKRO America, but FAKRO shall not be held responsible for any errors or negligence in arrangements of the carrier contract or for any defalul on the carrier’s part. Loss or damage that occurs during shipping by a carrier is your responsibility.

Indemnification
You agree to defend, indemnify, and hold FAKRO America harmless from and against all claims, demands, damages, costs, and expenses, including attorneys' fees, arising from or related to your use of the Website, your breach of these Terms and Conditions, and/or any of the foregoing agreements or obligations, representations, and warranties.

Returns
Most items in original condition may be returned within 30 days from delivery. Merchandise must be returned in unused, like-new conditions. Products may not be returned without prior authorization. For return of the products, please contact FAKRO America at 630/543 1010. A restocking fee of 25% will be charged of the product's invoice value. Product return shipping costs are to be covered by person returning the product.

Our Liability
These terms and conditions set out the full extent of FAKRO America obligations and liabilities in respect of the supply of the Products (and performance of telephone support and warranty services) and the performance of any Services.
There are no warranties, conditions or other terms that are binding on us regarding the supply of Products or the provision of Services except as expressly stated in this Terms and Conditions.

Any warranty, condition or other term arising out of or in connection with the supply of Products which might otherwise be implied into or incorporated in the Terms and Conditions by statute, common law, laws applicable in the different states, or otherwise (including without limitation any implied term as to quality, fitness for purpose, reasonable care and skill) is hereby expressly excluded to the maximum extent permitted by law. In particular, we will not be responsible for ensuring that the Products are suitable for your purposes.

FAKRO America will not be liable for any loss of income, loss of profits, loss of contracts, or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.

FAKRO America maximum aggregate liability under this Terms and Conditions whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to FAKRO America in respect of the Product(s) in question


Service and Support
FAKRO America will provide general service and support, to you in the United States, in accordance with the then-current service and support policies and conditions in effect. For owner’s of FAKRO products FAKRO America promises that its service people will try to help you over the telephone any problem involving FAKRO products.

Applicable Law
We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so within The State of Illinois.

All copyright, trademark, and other intellectual property right in all material, including images, illustrations, designs, photographs, clips, and all written material on this Website is owned by FAKRO Company. None of the material may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means without written permission from FAKRO .Unauthorized use of any material on this Website may violate copyright, trademark laws, the laws of privacy and publicity, and communications regulations.

Trademarks
FAKRO, fakrousa.com, and other marks used on the Website are registered trademarks of FAKRO CORPORATION or its subsidiaries, in the United States and other countries. Fakrousa.com graphics, logos, headers, icons, scripts are trademarks and property of FAKRO.

That is why protecting any personal information provided by you during registration and ordering process, such as your name, address, email address, phone number, credit card number and expiration date is of the utmost importance to FAKRO. As a result, of the collected data protection, FAKRO will not trade, rent or sell your personal information, without your prior consent.

We personalize your shopping experience by using your purchases to shape our recommendations about other merchandise that might be of interest to you. We also monitor customer traffic patterns and site usage to help us develop the design ona layout of the store.
